Removing Federal IRS Tax Liens (cont.)


The IRS releases a tax lien by issuing a Release of the Notice of Federal Tax Lien. The IRS will issue this release within 30 days after

i) You satisfy the federal tax due including interest and other additions by paying the tax lien debt or by having it adjusted, or

ii) The IRS accepts a bond that you submit, guaranteeing payment of the tax lien debt.

To have a tax lien removed, you must contact the IRS as instructed in your Notice of Federal Tax Lien and make arrangements for payment of the entire amount or enter into a payment plan with the IRS as quickly as possible. You must make these payments on time as agreed or you could have further problems including fines. Once you make all the payments, you can initiate the process to start the release. You must draw up the Release of Federal Tax Lien which describes the lien filed against you, the date on which it was filed and where it was filed. The Release of Federal Tax Lien must be signed by the IRS official and state that the tax debt you owe has been paid in full or as agreed between you and the IRS and that they are releasing you of any further tax debt due. You must then record the Release of Federal Tax Line with the appropriate county office.

A federal tax lien against you will remain a matter of public record until it is paid off in full, including all additions and accruals or according to your arrangement with the IRS. The IRS may withdraw a filed Notice of Federal Tax Lien if:

1.The notice was not filed according to IRS procedures or was filed too soon.
2.The collection will be faster if the notice is withdrawn
3.The withdrawal is in the best interest of the US Government and the tax payer
4.Taxpayer enters into an installment agreement to pay the tax lien debt
